Beneyto20 years ago, on February 25th 1994 at the age of 86 years, Juan Beneyto Pérez died in Madrid, a philosopher of law and policy; began as a theorist and a defender of the Fuero rights, but after studying in Bologna and Berlin became a supporter of fascism and National Socialism, committing to the national- syndicalist movement (JONS) of Ledesmy R. Ramos, a co-founder of the Falange "Arriba" organ, during the civil war a General Director of the Press Council and chairman of the Spanish – German Association, after the war a longtime head of the Department of Law at the Complutense University of Madrid, a member of the Royal Academy of Valencian culture; beside L. Legaza Lacambry and FJ Conde a chief representative of the Francoist state jurisprudence: in the first phase a theorist of a totalitarian state, as "the people's authoritarian state", and a mono- party, which is reflected in a "hierarchical leadership" with the leader (caudillo) at its head which is also a "self-creating monarchy“, but interpreted as a contemporary application of Thomistic "mixed government" (and the Visigoth tradition), where the leader is the equivalent of the king and the monopartia – of the aristocracy and spiced up by quotes from traditionalists (Donoso , Balmes, Mella), in the second phase departed from the totalitarian concepts, turning to Catholic conservatism and recognising Francoism as neotraditionalism.
